General conditions of use

Preamble

Users are only able to take advantage of the services offered to them on this site provided they accept these general conditions of use. The site user acknowledges having read and understood the conditions of use and agrees to comply therewith. The user acknowledges that he has the competence and resources necessary to access and use the site.

Purpose

The purpose of this document is to fix the conditions of use of the Website accessible at http://www.euripides-eureka.eu.

Entry into force - Term

These conditions of use come into force as at the date they are put on-line and will be binding as at the date the user first uses the site. These conditions of use are binding throughout the whole period of use of the site and until new conditions of use replace these conditions. The user may at any time withdraw from using the services and the site but remains liable for any prior use.

Links

EURIPIDES² reserves the option of putting links in place on its Website giving access to Web pages other than those on its site. Users are informed that any sites they may access via the links do not belong to EURIPIDES². EURIPIDES² declines all liability as regards the content of the information supplied on these sites pursuant to activating the link(s). The placing of a link towards this Website without EURIPIDES², express prior authorization is prohibited. The Web editor shall not be liable for access by users via links present on the site to other resources presented on the Internet network.

Cookies

Users are informed that when they visit the site, a cookie may be automatically stored in their browser(s). Cookies record certain information which is stored in the memory of the user’s disc (cache). In no case do cookies contain any confidential information, but they do enable pages browsed by the user to be kept in memory. Users have a right of access, removal and modification of the personal data concerning them communicated by means of the cookies. Web editor’s liability

EURIPIDES² shall not be liable for:

  • the quality of the service, the service being offered “as is”;
  • any disruption in use of the site;
  • the impossibility of using the site;
  • breaches of computer security that might cause damage to users’ computer equipment and their data;
  • any breaches of users’ rights generally.

The Web editor uses its best endeavours to offer users information and/or tools available and checked but shall not be held liable for any errors, absence of availability of information and/or the presence of viruses. The information provided by the Web editor does not exempt the user from additional personalised analysis. The Web editor does not warrant the accuracy, completeness or currency of the information disseminated on the site. Accordingly, users acknowledge that they use at their own exclusive liability.

User’s liability

Users agree to use the services of the site together with all the information to which they may have access for personal reasons only and for purposes compliant with public policy, public morality and rights of third parties. Users acknowledge that they have checked that the computer set-up used by them contains no virus and is in perfect working order. Users agree not to disrupt use by other users of the site and not to access parts of the site for which access is reserved. Users agree not to commit any act that could jeopardise the computer security of EURIPIDES² or other users. Users agree not to interfere with or interrupt the normal operation of the site. Users agree not to carry out any act for commercial, political or for advertising purposes or any form of commercial canvassing and specifically the sending of unwanted e-mails (spamming). Users agree not to collect, use or process the personal data of other users in any way whatsoever. Users agree to hold EURIPIDES² harmless in case of complaint, claim, legal action, proceedings and any orders against the EURIPIDES² arising from non-compliance with the conditions of use by them.

Intellectual property

The elements belonging to EURIPIDES² such as the Website, trademarks, drawings, designs, images, texts, photos, logos, graphics charters, software, search engines, databases... without this list being exhaustive, are its exclusive property. These conditions of use do not carry with them the assignment of any sort in favour of the user of any intellectual property rights over the elements belonging to EURIPIDES². Any representation of the site in full or part by any company whatsoever without the Web editor’s express authorization is prohibited and constitutes an infringement punishable according to articles L.335-2 et seq of the Intellectual Property Code. The same applies to the databases included on the site which are protected by the provisions of the law of 1st July 1998 enacting transposition into the Intellectual Property Code of the Community directive of 11 March 1996 relating to legal protection of databases. The trademarks of the Web editor and its partners, as well as the logos included on the site, are trademarks (semi-figurative or not) and are registered. The trademarks and logos included in the section 'About EURIPIDES² and “Projects” belong to the companies quoted. Any reproduction of these trademarks or logos in full or in part made on the basis of elements on the site without the Web editor’s express authorization is thus prohibited by article L.713-2 of the Intellectual Property Code.

Professional messaging service

The electronic messaging address of EURIPIDES² and every one of its members is reserved for business use only. Any professional files or documents intended for EURIPIDES² must be forwarded to these business addresses.

Governing law and jurisdiction

These conditions of use are governed by French law. This applies for both substantive and procedural rules. Any dispute arising from the application of these conditions of use will be of the competence of the French jurisdictions.
